On June 1, two laws came into force: on the conditions for entrusting work to foreigners in the territory of the Republic of Poland and on the labor market and employment services. Important changes include an increase in unemployment benefits to PLN 1,722 and the abolition of the link between an unemployed person and the employment office responsible for their place of residence.

In accordance with the regulations, two acts entered into force on 1 June: on the conditions for the admissibility of entrusting work to foreigners on the territory of the Republic of Poland and on the labor market and employment services.

The latter replaced the Act on Employment Promotion and Labor Market Institutions, which had been in force for 20 years. The regulation envisages a comprehensive modernization of labor market institutions, and the reform was included in the National Recovery Plan.

The Ministry of Family, Labor and Social Policy explains that:

  • The link between an unemployed person and the employment office responsible for their place of residence has been abolished. Therefore, an unemployed person can register with the district employment office in which they reside;
  • the Act also provides for the implementation of a new IT system that will enable online assistance and provide better access to good quality job offers;
  • the new regulations also enable, among other things: the introduction of the possibility of co-financing the employment of retirees; enabling farmers to register at employment offices; providing priority assistance to unemployed people from large families and single parents;
  • increasing the effectiveness and availability of the National Training Fund; introducing an educational loan of up to 400% of the average salary;
  • The act abolishes the unemployment benefit of 80% of the basic benefit for unemployed people whose qualifying period is less than 5 years. Such people will receive the benefit at 100% - PLN 1,722 in the first three months and PLN 1,352.29 in the following months .

New regulations regarding foreigners

In the case of the Act on the Employment of Foreigners, it limits abuses, streamlines procedures, reduces backlogs in official cases, and ensures the full electronicization of proceedings. This is also one of the milestones envisaged in the KPO.

The following were introduced, among others:

  • The starosta (district head) may establish a list of professions and job types for which work permits will not be issued to foreigners intending to work in a given district . It is envisaged that the obligation to prepare such a list will arise in the event of a significant deterioration in the local labor market, after obtaining a positive opinion from the district labor market council.

At the same time, the National Labor Inspectorate reminds that the new law has incorporated provisions specifying the obligations of entities entrusting work to foreigners. These include requiring foreigners to present a valid document authorizing their stay in Poland before commencing work and retaining a copy of this document. These regulations have been clarified – the entity entrusting work will also have the right to require foreigners to present a current residence permit during the period of employment.

  • as a rule, the employer will also have to keep a copy of such a document for the entire period of work performed by the foreigner and for 2 years, counting from the end of the calendar year in which the legal relationship that was the basis for the foreigner's employment was terminated or expired.

Additionally, district employment offices will set up points for foreigners. The procedure for issuing work permits to foreigners will also be fully electronic, from submitting the application to receiving the decision.

  • Penalties for illegally employing foreigners will be tightened. Violation of the regulations will result in a fine of PLN 3,000 to PLN 50,000 for each instance of such employment.
