This right applies as long as the person worked at least that same period of time—or longer—continuously and immediately prior to the layoff. That is, if the worker had a valid employment relationship during the last two months prior to becoming unemployed , they may continue to use IMSS medical services for the following eight weeks.
The law stipulates that "Any insured person who is deprived of paid work, but who has immediately before such deprivation made a minimum of eight uninterrupted weekly contributions, shall retain, for eight weeks following unemployment, the right to receive exclusively necessary medical, maternity, surgical, pharmaceutical, and hospital care. Their beneficiaries shall enjoy the same right."
As mentioned, the benefit also extends to family members who were discharged during the employee's active employment period. This means that if the employee registered their partner, children, or other family members on their insurance, they will also retain the right to receive medical care during the same period following their discharge.
